For SLAPP suits, the burden of proof for potentially-dispositive motions is inverted from what is typically seen. The different burden is directed by Rule 3211(g) of the CPLR, which was initially enacted by the state legislature in 1992 (L.1992, ch. 767, sec. 4) and amended in 2020 (L.2020, ch. 250, sec. 3). It provides that a party may move to dismiss a SLAPP complaint, cross-claim, or counterclaim by merely establishing that it qualifies as a SLAPP claim as defined by Section 76-a(1)(a) of the CRL.
Significant directives should be confirmed in writing to ensure clarity and mutual understanding. If a subordinate questions a directive on ethics grounds, generally the issue should be discussed, documented and researched—not summarily dismissed. If disagreement persists, the issue should be elevated in the firm. Tunnel vision and “office custom” make poor defenses in the ethics arena.
Sentencing decisions carry profound consequences, yet the environments in which those sentences are carried out have often remained distant from judicial view. By bringing judges into correctional institutions in a structured and meaningful manner, the program seeks to bridge that divide.
