Strength in Numbers: A Summer Reflection on Partnership and Purpose.

In the event of an unforeseen circumstance where the publication cannot be made or completed as ordered by the court, Section 2401(1) of the CPLR permits the court to direct that the publication occur in another newspaper instead. If publication commences in a newspaper which ceases publication before the service is completed, the plaintiff may use a different newspaper without any additional order from the court (CPLR § 2401[2]).
