"With the phased expansion of public and private business throughout the State, and the corresponding expansion of court activities (including broader permitted filings through NYSCEF and by mail), we anticipate an increase in applications to clerks for default judgments pursuant to CPLR 3215(a) in coming days and weeks.  As you consider these applications, please keep in mind (1) Governor Cuomo’s Executive Orders No. 202.8 (March 20, 2020) and 202.28 (May 7, 2020), which, inter alia, tolled the specific time limits “for the commencement, filing, or service of any legal action, notice, motion, or other process or proceeding, as prescribed by the procedural laws of the State” (EO 202.8, p. 1), and (2) Chief Administrative Judge Marks’s Administrative Orders AO/71/20 (March 19, 2020) (deferring proceedings when, as a result of the COVID-19 public health emergency, “a  party, attorney or other person  is unable  to meet discovery or other litigation schedules [including dispositive motion deadlines]”) and AO/78/20  (March 22, 2020) directing that clerks accept papers only in “essential matters,” listed in Exh. A of the AO, until further order.  (Copies of these orders are attached.)  If a default application addresses a time period covered by one or more of these orders, the applicant should be advised to present the matter to a judge for review."

Beginning Monday, May 25, e-filing through the NYSCEF system -- including the filing of new non-essential matters - will be restored in those counties of the state that have not yet met the benchmarks required to participate in the Govemor's regional reopening plan. Those counties include the five New York City counties, Nassau and Suffolk counties, and Dutchess, Orange, Putnam, Rockland, Sullivan, UIster, and Westchester counties.

"Electronic Filing – Civil Matters – Supreme: Message from Jeff Carucci: Can you please advise all NYSCEF Supreme Civil Courts that as a result of the Administrative order, and in accordance with the directive in the EDDS Notice, which reads that EDDS should not be used in matters where NYSCEF is available on either a mandatory or consensual basis, we will be removing all case types from the EDDS drop-down menu for those courts listed in Exhibit A of the Order.  
 
The only Case and Document Type in NYSCEF Courts that will be available for sending via EDDS is the Stipulation and Consent to E-Filing in order that a request to convert paper to e-filed matters (now available in all matters) may be sent.  
 
Please note that routing for all new case types will be set to mirror the present TORT case type in your court. Should you need assistance in updating the routing of documents or need to create new groups or new users, please reach out to the NYSCEF Resource Center by email to efile@nycourts.gov."
