"As you should be aware, the 9th JD has moved to Phase 3 as of Thursday June 25, 2020.

For Family Court, all ‘’essential” matters, bench trials, permanency hearings, child support and Article 10 evidentiary hearings shall presumptively be heard in person.  However, JD and PINS proceedings shall presumptively be heard virtually.  Cases are being scheduled in staggered calendars.

Everyone appearing in person at the court house should wear a mask and follow all social distancing and safety protocols listed on the nycourts.gov webpage and in attachments.  Please forward this information to your members."

Administrative Judge Kathie E. Davidson presided over a meeting with agencies and stakeholders from the 9th Judicial District to discuss the District’s Return to In-Person Operations Plan (RIOP). Among those who attended the video-conference were representatives of various bar associations, legal services and legal aid organizations, as well as public defenders and district attorney offices. During the hour-long meeting, Judge Davidson discussed the measures being implemented as part of Phase II of the RIOP and preliminary considerations for Phase III. Below are some highlights of the meeting:
 
In-person court appearances: other than essential matters, the presumption is for cases to be heard virtually unless a request to appear in-person is made to the on-duty or assigned judge and the request is granted. A determination will be made at the judge’s discretion taking into account, for example, the needs of any pro se litigants.
 
Town and Village courts: these courts are operating with clerks and judges available including to hold arraignment hearings. However, some buildings are not yet open to the public in which case the judge must be contacted by phone including to schedule a virtual arraignment either during the day or evening. In the event that a Town or Village judge is not readily available to conduct an arraignment, they will be conducted at the centralized part.
 
Access to courts by general public: access points or anterooms to court facilities are being set up throughout the 9th District counties to allow residents access to courts via computers or phone lines.
 
Courthouses: no one can enter a court facility without a mask covering their mouth and nose. Coverings are being provided to criminal defendants prior to arraignment hearings. Courthouses have distancing markers to assist members of the public to comply with social distancing requirements. Court visitors are required to undergo approved COVID-19 screening, such as temperature checks, before entering the courthouse.
 
Next steps: considerations are being made to take steps for the gradual increase in court operations including jury trials and grand jury proceedings. Among some points being discussed are, for example, whether witnesses in jury trials should wear face shields instead of face masks in order to allow the witnesses’ facial expressions to be visible.
 
Judge Davidson encourages the legal community to submit their comments and concerns relating to the 9th District’s ROIP to be considered for Phase III and IV.
