Real Property Section

The Real Property Law Section of the Westchester County Bar Association is pleased to welcome Section members, members of the Bar, and visitors. Among the resources available on this web page are case reviews of interest to the members, meeting notices, upcoming CLE announcements, and other things of interest to members.

The purpose of the Section is to bring together members of the Westchester County Bar Association who are interested in real property law, title issues, transactions, and litigation, as well as the promotion of  the interests and welfare of the public and members of the Bar in real property law.  The Section strives to furnish constant and active support of its members to maintain and protect legal jurisprudence and the principles of real property law, as well as the professional development of the Bar in matters relating to real property law.  The Section also serves as a forum for real estate lawyers to meet others who have similar interests.

The Section is proud of the programs that it has undertaken, including litigation to prevent real estate brokers from unlawfully preparing contracts of sale, improvement of recording procedures of the Westchester County Clerk, and training paralegals and other non-lawyers to prepare and record real estate documents.

State Adds Foreclosure Action Fee Pursuant to C.P.L.R. §8018

 August 11, 2010  

 NOTICE: State Adds Foreclosure Action Fee Effective SEPTEMBER 1, 2010, all new actions for foreclosure pursuant to Article 13 of the Real Property Actions and Proceedings Law must be accompanied by a fee of one hundred and ninety dollars ($190.00) in addition to the Index Number fee of two hundred and ten dollars ($210.00).

The Office of the Westchester County Clerk is mandated to collect this additional fee on all Foreclosure Actions received by the office on or after SEPTEMBER 1, 2010.
In order to avoid delay in handling and processing, all commencement papers and appropriate fees must be addressed to:
