As the New York State Courts continue to calibrate and adjust operations in response to the COVID-19 pandemic, Deputy Chief Administrative Judge Vito C. Caruso, under the guidance of Chief Judge Janet DiFiore and Chief Administrative Judge Lawrence K. Marks, today announced that the “virtual court” model introduced last week in New York City’s Criminal Court and Family Court to minimize courthouse traffic and contain the spread of the virus is being implemented outside New York City. Virtual court operations will begin this week in Suffolk County’s District Court and County Court; the Rochester area’s Seventh Judicial District; and Central New York’s Fifth Judicial District.

The Court of Appeals today announced that the New York State Bar Examination will not be administered on July 28-29, 2020 as previously scheduled.
The Bar Examination will be rescheduled for dates in the fall, to be determined.
When available, the Board of Law Examiners will announce the rescheduled dates for the examination and for the application filing period.

Effective today, March 25th, 2020, New York City Criminal Court initiated its second phase of videoconferencing arraignments. Going forward, all parties will participate in court proceedings by videoconferencing using Skype for Business. All arraignments will be virtual, with the Judge, prosecution and defense attorney and defendant all from remote locations.
Non-COVID-19-involved defendants−those who have not tested positive for COVID-19 or are not in a high-risk group−will be brought to the central booking.
COVID-19-involved defendants−those who have tested positive for COVID-19 or are in a high-risk group−will be detained pre-arraignment to participate in video arraignments at either Midtown Community Court or Red Hook Community Justice Center.

Due to our current health crisis the Rockland Supreme, Criminal, and Family Courts are moving towards virtual courts.
The Courts will be using the telecommunications application Skype. In order to appear in Court an attorney must use Skype.
Appearances will now be limited to arraignments and immediate access cases.

New York State Chief Administrative Judge Lawrence K. Marks issued an Administrative Order earlier today that effectively halts all court activity in New York with the exception of
The order is effective immediately.
The list of essential proceedings is subject to ongoing review and amendment as necessary, and currently includes the following:
Bail applications, reviews and writs
Temporary orders of protection
Resentencing of retained and incarcerated defendants
Essential sex offender registration act (SORA) matters
Child protection intake cases involving removal applications
Newly filed juvenile delinquency intake cases involving remand placement
Applications, or modification thereof
Emergency family offense petitions/temporary orders of protection
Orders to show cause
Stipulations on submission
Mental Hygiene Law (MHL) applications and hearings addressing patient retention or release
MHL hearings addressing the involuntary administration of medication and other Medical care
Newly filed MHL applications for an assisted outpatient treatment (AOT) plan
Emergency applications in guardianship matters
Temporary orders of protection (including but not limited to matters involving domestic violence)
Emergency applications related to the coronavirus
Emergency Election Law applications
Extreme risk protection orders (ERPO)
Applications addressing landlord lockouts (including reductions in essential services)
Applications addressing serious code violations
Applications addressing serious repair orders
Applications for post-eviction relief

Specifically the EO states: I hereby temporarily suspend or modify, for the period from the date of this Executive Order through April 19, 2020 the following:
In accordance with the directive of the Chief Judge of the State to limit court operations to essential matters during the pendency of the COVID-19 health crisis, any specific time limit for the commencement, filing, or service of any legal action, notice, motion, or other process or proceeding, as prescribed by the procedural laws of the state, including but not limited to the criminal procedure law, the family court act, the civil practice law and rules, the court of claims act, the surrogate's court procedure act, and the uniform court acts, or by any other statute, local law, ordinance, order, rule, or regulation, or part thereof, is hereby tolled from the date of this executive order until April 19, 2020; the date of the Executive Order is March 20, 2020.
