Municipal Law Committee

Mission of the Municipal Law Section

The purpose of the Municipal Law Section is to carry forward the work of the WCBA by:

(a) providing a common meeting ground and networking forum for those members of the WCBA, as well as municipal officials who practice in, or are involved with, confronting problems in municipal law;

(b) furthering a better understanding of municipal law for those members of the WCBA who serve as local government attorneys, or who are engaged in representing individuals before local government agencies, through the holding of meetings and seminars featuring knowledgeable speakers and covering a wide spectrum of topics in local government law; and

(c) disseminating timely and pertinent materials analyzing judicial decisions, legislation, and other matters of interest to attorneys practicing municipal law and local government officials grappling with day to day municipal issues.

A Letter From the Chair

Welcome to the Municipal Law Section web page. I first joined the Section shortly after I was appointed as an Assistant Westchester County Attorney in 1985. Throughout my ten years with the Westchester County Attorney’s Office, where I rose to the rank of Assistant Chief Deputy County Attorney, as well as my nine years as Chief Deputy Corporation Counsel for the City of White Plains, I have found membership in the Municipal Law Section of the WCBA to be a very helpful tool for networking with other municipal law practitioners and officials and for sharing information and ideas in an area of law that is an enigma to many. The Section serves as excellent educational resource by offering educational and practical seminars presented by distinguished and knowledgeable speakers.

The Municipal Law Section hosts at least six luncheon meeting seminars every year which are usually held on Tuesdays, from 12:30 p.m. to 2:00 p.m. at local restaurants such as Ernesto’s and Vintage in White Plains. Attorneys attending these seminars receive one CLE credit per meeting and speakers receive three CLE credits. The topics presented at these luncheon meetings have included timely and relevant issues confronting municipal lawyers, such as zoning and land use development, civil service and disciplinary proceedings, the role of local development corporations, drafting and enforcing municipal codes of ethics, City Court practice and prosecution from the prospective of local prosecutors, defending municipalities in civil rights litigation, the interaction between the Westchester County District Attorney’s Environmental Crimes Bureau and local governments, the practice of municipal law from the viewpoint of a local government official and an update on SEQRA and Brownfield litigation and advice for dealing with the New York State Department of Environmental Protection. Upcoming areas of discussion include telecommunications, tax certioraris, the Freedom of Information Law and Open Meetings Law, and defending Article 78 proceedings.

Members of the WCBA who are interested in the practice of municipal law from either the public or private sector are encouraged to join the Municipal Law Section.
